Volume 15, Issue 7 July 2007 Environmental Groups Try to Ban the Opening of a Private ORV Park in NY RPM'S @ Glen Creek is seeking permission to construct a private track and ATV trail riding facility on 738 acres in the Johnsburg/Thurman area in Warren County. The project has been submitted to the Adirondack Park Agency (APA) for permit approvals. Fringe environmental groups such as the Residents' Committee to Protect the Adirondacks (RCPA) have been successful in their crusade to outlaw recreational ATV use on public land within the Adirondack Park. Now the RCPA wishes to block ATV use on private property. RPM's @ Glen Creek needs to show the APA and local planning boards that the proposed ATV park has public support. After hearing a set of recommendations from Park Commissioner Richard Bean and listening to several residents, the supervisors agreed to draft an ordinance and advertise it for adoption at the next meeting. Supervisors were pleased with the recommendations Bean presented as they each weighed in on them. They then held a discussion to determine the stipulations they wanted in the proposed ordinance. Here are the stipulations agreed upon by the supervisors for the proposed ordinance: • permits to ride ATVs at the park be $5 per adult and $1 per child under 16 years old Township solicitor Jeff Osmond didn't agree with making the permit five years, as recommended. He said two years would be better, noting things such as insurance and registration can change over five years. The supervisors appeared to agree with him. Only one person, speaking from the back of the audience, spoke up and addressed supervisors in objecting to having the permits be for two years. Other stipulations agreed upon included: • the fine for not having a permit be $100 on the first offense and $500 on the second offense; someone's permit would be taken away automatically if they were caught breaking the rules • riders must ride on designated trails • no fee for a permit will be charged when someone is home on leave from active military duty and wants to ride at the park Money from fines will go to the park. One of the residents in the audience speaking was Ian Clare. "We're pleased you're going to continue allowing us to ride up there," he told the supervisors. He also said he had a petition with 200 signatures. The petition reads, "We the undersigned support the continuation of an open trail system at Round Top Park in Athens Township for use by dirt bikes and ATVs. We also support the existence of, enforcement of, and adherence to the established rules of the trails. These rules include, but are not limited to riding in designated areas only, complying with all state and local laws and ordinances and maintaining a litter-free environment both on the trails and in the designated parking area. On these principles, we request continued access to the trails and we express our support for and compliance with the rules and laws set forth." Gary Wilkinson, who said he has been using the park for 30 years and is a founder of the Valley Off-Road Recreation Club, thanked the supervisors for working with the riders. "I love Round Top; it's a big part of my life," he said. He added, "as a citizen, I'm here to tell you that the park is in the best condition I have ever seen it. You have never seen this much green grass. I admit that there's damage and problems going on up there. I'm just glad that we're willing to work on it." When asked to provide background on the issue, Township Supervisor/Secretary Robin Smith said, "There were people that were riding where they shouldn't be. There's so much noise. The issue that was critical to me personally was that people who were trying to have picnics up there couldn't hear." Initially, she said the park commission recommended the township get rid of all off-road motorized vehicles. "But we weren't real happy with that," she said. She said a meeting was held in the middle of June and issues were brought up. "One thing that came out at that meeting was that the walking trails are the same colors as the riding trails," she said. "As we talked back and forth, all these issues came forward," she said. "We can easily resolve most of them, and I think the permitting process will resolve the rest of it." The proposal for land off Route 28 is drawing questions from the Adirondack Park Agency, criticism from environmentalists and support from ATV riders who have long complained that the state takes registration fees while barring the vehicles from public land in the Adirondacks. A proposal by Queensbury Falls residents Richard and Karen Mohring for a Glen Creek Road site filed in April with the park agency calls for about 30 miles of backcountry ATV trails, along with six tracks, including a drag strip, and more than 150 camping sites, six rental cabins and four single-family homes. The park agency is taking a close look, as shown by an 11page letter filled with follow-up questions on the project. "The potential for significant adverse impacts to these sensitive resources from the large- scale, intensive development is very real," wrote Deputy Director Mark Sengenberger. Environmental groups and ATV advocates appear poised to square off. This week, the Residents' Committee to Protect the Adirondacks opposed the plan. "This type of outdoor motor sports facility is an intensive and abusive activity that is not suitable for this land or for the Adirondack Park," said committee Executive Director Peter Bauer. "The soils are easily eroded, the property contains many steep slopes and extensive wetlands, borders Forest Preserve, necessitates the crossing of Glen Creek Road, and the noted trout stream Mill Creek/Beaver Brook meanders through the property." Gregg Urspung, an engineer from Saratoga Associates representing the Mohrings, had no comment Thursday. But Bob Ski, executive director of the New York State Power Sport Dealers Association, said ATV owners need places to ride because the state bars them from three million acres of public land. "Unless we form a managed program for this activity, sometimes ATV riders may be someplace where they should not be," said Ski, who is an adviser to the New York State Off-Highway Recreational Vehicle Association. "Trespass goes away if you provide the opportunity to recreate." In a state with more than 143,000 registered ATVs, there are six private ATV parks. Ski said more than 30,000 new vehicles are sold each year, but about 20,000 owners let their registrations lapse out of frustration.
