Volume 14, Issue 1 January 2006 Point-of-Sale Registration Now Required in New York NYS DMV has now released the details on the POS ATV Registration program. Dealers may now order temporary registration certificates from DMV. Established, registered dealers may apply to stock ATV plates. Registration Exemption forms are 3-part and only available on paper from DMV, contact your local DMV office. From the original notice dated April 5, 2005: - DMV dealer program in development, otherwise requires Dealers to visit DMV offices -Applies to all ATVs including off-highway motorcycles, MX exemption overlooked in the law (DMV said to be incorporating the exceptions administratively) - POSR requirement effective April 1, 2005 With the passage of legislation to re-establish an ATV Trail Fund, the State Budget included a surprise for Dealers of ATVs and trail bikes—a new requirement to register any such vehicle before the machine leaves the dealership. POS registration of "ATVs" is the Law of NYS effective April 1, 2005. (An ATV registration fee increase, from $10 to $25 to fund the Trail Fund, will be subsequently effective June 29th.) Immediate effectiveness of POSR, no implementation language in the Law, and no policy precedent, gives the NYSDMV no guidance on how to establish a program that requires a special form for exemptions, nor is a stocking plate program addressed. DMV has requested NYSORVA’s help in spreading the word to dealers and industry contacts. They will produce a mailing to Registered Motorcycle Repair Shops and a general press release to news agencies, while they develop the working details of the POSR program. In the absence of a stocking plate program, the only option for response of the dealers is—like many dealers already do—to go to the local DMV and process the registration transaction on behalf of the customer. The glaring error in the POSR law, which has been reported to the Legislature and DMV policy officials is the matter of Registration Exemptions: the law ignores agriculture/plowing and competition exemptions resident in the existing V&T law as valid grounds for allowing a machine out the door without an ATV plate. This problem will confront your MX and hair scramble customers (quad and bike) and farmers too. (Recall that in NY, MX and other types off- road motorcycles are ATVs by legal definition —unless such bike has a highway plate, then it is a "motorcycle" under NYS V&T.) We have no information on whether there is a punitive response for dealers’ failing to comply with this new POSR requirement. Members will be receiving the minutes in the next week. At our last meeting Jan. 14 we enjoyed a productive meeting with 14 members present. Thanks Again to Ralph & Pat Miller for hosting the meeting. Originally this get together was planned as a post Holiday get together with a possible ride. With the weather being unpredictable the ride was put off. During the meeting we watched out the windows as a winter storm started to brew. Our next club meeting will be March 13th. We are hoping this will be at the Mansville Rescue Building which we hope to secure for our regular meetings. It is fairly new with easy access off of Interstate 81 and on Route 11 in the village. CLUB DONATION: We where recognized for our contribution to the Black River ATV club and had a picture taken with them and the snowmobile club who both donated summer and winter rescue toboggans to the Carthage Fire and Rescue Department. At our meeting we were approached by the Battalion Snowmobile Rescue Group out of Orwell who will also be having fund raisers to purchase a rescue sled and equipment for their area. Will keep everyone informed as time comes. News from the County: politics never cease to amaze us. The simple things seem to get dragged out. The Jeff. Cnty. Trail Coordinator has temporarily stalled again. Soil and Water will manage it. Hopefully things will come together and the posting / job description can be put together and out in Feb. Really don’t feel that they can find and hire someone at this point ’til late March, April. WFRA: Our association with the Winona Forest Group has steadily improved over the winter. With the crazy weather the long hard work that their group has done for the trails has been melted and washed away with the thaw and run-off in full force. Tentative plans are in the work to have our club host a pilot program for repair and development of a Trail System on the County Forest section of their trail system. It has been out of commission for several years so will need a lot of work. There will be many things coming together over the next few months. We are hoping for a positive outcome from the state as far as an ATV policy, Trail Funding and development. We hope to bring everyone together to discuss the Insurance issue that we face and different options that we need to agree on to move Forward with Trail Plans. Volume 14, Issue 1 Page 6 Chapter News NYTRO Central NY January 30, 2006 Well the ride last Saturday the 28th at ALL County ATV Club was a great success, we had about 60 + riders and the weather was absolutely perfect. We started out as planned at the Iron Skillet restaurant right off Thruway exit 41 at 8:30 in the morning for breakfast. As you looked out the window from the table inside, the trucks and trailers with wheelers just kept pouring in the parking lot one after the other. We managed to stay somewhat on schedule and headed out the parking lot at 9:30 but did not yet sign up for the ride; we all headed toward the potato festival fields in Savanna, to find out the fields were too wet to drive that many vehicles into. At that point I think everyone noticed exactly how big our group was, at that time I think I counted about 35-40 vehicles. Berry from All County took us to another nice parking lot near the trails to unload, it seemed like a municipal parking lot where there was recycled asphalt millings and stone stockpiled up, but there was plenty of room for us to offload the machines, with Berry’s guidance. From there we went down a short trail (about 2 miles) to Berry’s house where he and his wife graciously let us in their home with all our gear on to sign up. The prices were $10.00 for the day ride or you could pay $15.00 for the ride plus join the club for the rest of there season witch is till April 30th 2006. Let the ride begin! After a short briefing about what was expected of us as riders and new members by one of the club’s leaders, we grouped up in 4 different groups of around 15 riders each. Each group had a good leaders that ranged from aggressive fast riders, too easy going, sight seeing, and husband /wife type riders. We finally headed out to the trails about 11:00 in 4 different directions on different trails which got each group good and separated from one another. Our group started out cross a deep creek-bed crossing toward Port Byron. Once in Port Byron, we got gas if we needed or water, snacks etc. Then we headed out to find the mud. And man did we find it; there was mud and more mud and lots of it! All and all we ended up with about 50 miles, the temps got up in the 50’s and it was just an awesome ride! Well organized, well managed, No break downs, no problems with the local authorities, no one got hurt, no problems that I was aware of at all. Some of us got back to the truck around 4:00 we started to load up, shot the bull for awhile, met some new friends exchanged phone numbers, then headed for home. Others went back out, had dinner in town on the quads then rode back to the truck in the dark. In the town of Montezuma you can legally ride the wheelers on the side of the road, as long as you’re registered and insured. I can’t wait till the summer time to try the trails. I hear the club has picnics and rides at least 1 Sunday per month throughout the summer months. Fatato The importance of wearing a helmet while riding an ATV simply cannot be overemphasized. A properly fitting helmet in good condition can easily make the difference between walking away from a crash or being carried to your final resting place. While your helmet is designed to protect you from an impact in a crash, it is not indestructible and should be treated with care to maximize protection. Some common tips on helmet care include: • Never store your helmet in a hot location, such as the trunk of a car in the summer. • Be wary of certain solvents, paints and adhesives applied to the exterior or interior of your helmet. These substances may react with and damage the helmet’s materials. • Prevent your helmet from falling, especially onto hard surfaces. Even a single drop from as low as two feet can ruin a helmet. Never drill, cut or modify your helmet in any way, shape or form. Any of the actions noted above could damage a helmet to the point that its protective properties will be substantially compromised. Even time takes its toll on helmets, and it's usually recommended that they be replaced every three to five years due to material degradation. In the event of a crash, some of the helmet’s materials are designed to break or crush upon impact, thereby absorbing the blow. The problem is that a crash could be severe enough to damage your helmet, yet it may show no visible signs of damage. If your helmet has been damaged in a crash and you continue to use it, it may not be able to properly protect you the next time you crash. This is a question that has vexed ATVers for a long time, leaving many a rider wondering if he should replace his helmet after an impact. However, other than sending the helmet back to the manufacturer for inspection, there was little one could do. Today, if you plan ahead, you have another option: install a Shok-SpotR on your helmet. Shok-SpotR is a first-of-its-kind helmet sensor that will indicate if the helmet has been exposed to significant impact that has likely caused damage. Shok-SpotR was the brainchild of an off-road dirt-bike desert racer who luckily survived a horrendous crash. Checking his helmet afterwards, he was astounded to notice that even after such a terrific impact, it showed no visual signs of damage. This near tragedy was the guiding force behind his eventual development of the Shok-SpotR. Shok-SpotR is a small device that easily attaches to the back of your new helmet with a pressure- sensitive adhesive (it is intended to be installed only on brand-new helmets, since used helmets may already be damaged without the rider realizing it). Inside the Shok-SpotR is a precision- engineered vial designed to rupture when exposed to acceleration above a certain point that has been determined through extensive testing to likely cause damage to the helmet. When the vial ruptures it turns the normally white indicator red. This provides a clear visual indication that the helmet has likely been damaged. Since helmets are designed to protect you for only a single blow, Shok-SpotR is a one-time-use sensor; if it's activated, the helmet has been exposed to an impact severe enough to damage it. At this point, it should no longer be used and should either be returned to the manufacturer for professional inspection or destroyed and replaced. For about $20, the Shok-SpotR is an affordable way to make sure your helmet is in good condition the next time you strap it on. If it turns out that the Shok-SpotR costs more than your helmet, you may want to take into consideration the old adage, “A $20 helmet for a $20 head”. Volume 14, Issue 1 Page 14 News ATV/OHM NY LEGISLATIVE UPDATE 1/19/2006 Governor Pataki has introduced his 2006-2007 State Budget proposal to again include provisions to create an ATV Trail Program. See the Legislation Page for NYSORVA's Legislative Position Statement, details on the ATV Trail Program proposal, plus background on the failure to deliver a Program in 2005 as promised in the State Budget Law—despite the registration fee increase to $25 imposed in that Budget. None of the estimated $2.5M registration revenue in 20052006 was ever returned to trails ($12M and counting since 1986). Now is the time to tell your State Senator and Assembly Member to GET ON BOARD and support the creation of an ATV Trail Program and Trail System. Along with the increase of our registration fees approved in 2005, from $10 to $25, we were promised in Law the delivery of an ATV Program in 2005—but it never materialized. Now is our Legislature’s opportunity to approve the Program proposed by the Governor and give us what we have been asking for since 1985—our own money to support our own properly- managed ATV trail system. Like NY’s lauded snowmobile tourism industry, the economic benefits of promotion of ATV tourism should go without saying.
