That we no longer had active officers in positions and that we were running under the direction of NYTRO Inc. until the officers positions could be filled. Some of things that were highlighted and were area’s of concern: lack of riding, communication, actives. These are issues that will be incorporated into the restructuring of the chapter. Joanne started out by saying that that the overall area’s that need to be addressed to make the chapter functioning again: Leadership, Communication, Member Involvement and Fundraising A brief description of how these areas fall into the Central Chapters board of directors. Paul Hansen and Jay Burke asked for descriptions of the positions that make up the Central Chapter board of directors. It was opened up to the floor as to if anyone was interested in holding any of these Interim positions until our elections in April 2005. It was decided that we would create an Interim Executive Committee. The people on this committee will assist and lead the club until said officer’s positions can be filled. The Executive Committee Staff: Jay Burke, Paul Hansen, Tony Alu, Dan Moyer, Tracy Moyer and Joanne Wemes. Jack Minehan, Jeremy Pratt. (Interim Ride Coordinators) The committee will meet on Feb 8. To further discuss how to reorganize. Tony Alu has offered to help with communications and is looking into having our own web page. Joanne stated that she is still waiting to hear from TrailPass regarding club insurance. Paul Hansen wanted to know what the operating cost was for the chapter and if we could email the monthly newsletter. It was decided to further this during our restructuring months. The Political Voice of NY’s ATV and Trail Motorcycling Community NYSORVA NEWS February 7, 2005 — General E-Mail News List Trail Funding Legislation Update At the urging of DEC, the Governor renewed the Trail Funding and Program proposal within his Executive Budget, released January 18, 2005. This year’s proposal contains all of the same defects delivered with the 2004 version, and a couple of new ones. Additional information will be made available as the story unfolds, at the Legislation page. See NYSORVA official Position Statement on the 2005 version of the proposal, or download print- friendly version to pass around. You are encouraged to strenuously lobby your Senator and Member of Assembly for the legislation to be improved. Utilize our web site if you need help. The AMA has provided an automated letter generating page that you are encouraged to use. State to Purchase Access Rights DEC will purchase public access rights by easement to over 84,000 acres of timber lands in Clinton and Franklin Counties formerly owned by Domtar Industries of Canada and now held by the Lyme Timber Company, a private timber investment company headquartered in Hanover, New Hampshire. DEC asserts that this time development of public ATV access will be actively pursued on at least a portion of these lands and will not have the roadblocks that scuttled the promise of over 150 miles made in 1999 when the state purchased a “recreation easement” to the former Champion lands. The difference, DEC says, is that access rights will be owned by DEC, and DEC alone will make the management decisions. In the case of Champion, DEC was beholden to the new landowner’s dictation of access terms. A guarded level of optimism accompanies this announcement considering the history of negative outcomes in past attempts by DEC to accommodate ATV enthusiasts. At the urging of DEC, the Governor introduced within his Executive Budget a sweeping ATV Program and Funding Proposal, in a form including much of what NYSOVA had been proposing over 12 years of lobbying the state. Although the proposal had very serious defects, it was the best opportunity ever to get pro-ATV laws enacted by the State Legislature. In the end, negative politics prevailed and the proposal was stripped from the final 2004-2005 State Budget. The lack of available private landowner liability insurance for ATV trails continued to make it nearly impossible for clubs to establish private land trails. In the Spring, a potential opening appeared, to retain a statewide policy, akin to that which the NYS Snowmobile Association had secured for snowmobile trails. However, this policy had a 6-figure-premium attached to it making it as good as no policy at all. The only way to afford such a policy — creation of a dedicated ATV Trail Fund — was not going to happen when it became clear in June that the Legislature was intent on stripping the ATV trail funding proposal from the State Budget. One particular successful public event stood out in 2004. One energetic OHV advocate independently went on a personal crusade to organize a political Rally at the State Capitol in Albany on June 15, 2004. NYSORVA supported the rally financially and technically, including access to its lobbyist, so that the efforts of the rally organizer and the clubs who assisted would have the most impact. On about two weeks’ notice, almost 100 riders representing several clubs, primarily from the Northcountry, convened on a perfect late Spring day to show the Legislature that riders mean business about ATV issues. July dawned with collusion by management decision of DEC and APA to ban ATV access to 54 previously ATV-legal travel routes in four wild forest units in Region 6 of the Adirondack Forest Preserve. The routes were closed based on a new interpretation of the Vehicle and Traffic Law (Article 48C, §2405) that applies to public roads open to ATV use. DEC officials have dubiously called this interpretation their “current thinking” on ATV access — in the absence of an official ATV Policy, long-rumored to be in the pipeline, to justify their actions. The Political Voice of NY’s ATV and Trail Motorcycling Community NYSORVA NEWS This outcome was largely born under the pressure of a lawsuit filed by the anti-access organization, Residents’ Committee to Protect the Adirondacks (RCPA), and broadly heralded by the state’s non-motorized and environmentalist organizations, most of which are supported by non-Adirondack sources. Since the closure of the access routes, RCPA has tentatively withdrawn their suit. In September, simultaneously with the official announcement by DEC Commissioner Erin Crotty of the closure of the 54 travel routes in the Forest Preserve, DEC applied the same legal logic to close previously authorized ATV trails in the Brasher Falls State Forest in St. Lawrence County — outside the Forest Preserve. The closures came despite the Tri-Town ATV Club having entered into a formal working relationship with DEC (an “AANR” agreement) and spending several working days in July and August to repair trails. Leading up to the agreement, Tri-Town and NYSORVA had pleaded with DEC for more than two years to work with the willing club members to actively manage the trails. Meanwhile DEC failed to follow their legal mandate to manage the upkeep of these authorized trails and subsequently let them fall into disrepair. But in the end, the closures were not as a result of trail condition, which was improving with Tri-Town’s efforts, but instead for the policy convenience of DEC officials in Albany who have been promoting a de facto ATV ban on the state’s public lands — despite their legislative mandate to promote recreation on reforestation areas. ******************************************************************** NYTRO NEWS Page 8 The CPSC released their 2003 ATV data SVIA News Release. Irvine, Calif., January 26, 2005 -- A report released today by the Consumer Product Safety Commission (CPSC 2003 Annual Report of ATV Deaths and Injuries) shows that while the number of four wheel all-terrain vehicles (ATVs) in use increased by 700,000 units between 2002 and 2003, the estimated injuries per 10,000 ATVs declined for the second year in a row. The report indicates that the ATV injury rate has declined 6.2% from 2001 to 2003. At the same time, the popularity of ATVs continues to increase. The number of ATVs in use grew 13% in 2003 from 2002. Since 1998, the number of ATVs in use has doubled. Although the overall number of injuries has increased, when the rising popularity of ATVs is taken into account, there has been no appreciable upward trend in injury risk during the six year time period since CPSC’s new injury sample and methodology has been in place. As noted, the injury risk has in fact declined from 2001 to 2003. Further, the report shows that the proportion of total ATV injuries sustained by riders under 16 has fallen from 37% in 1998 to 31% in 2003. The report also indicates that the risk of fatality per 10,000 ATVs has declined 21% from 1999 to 2002. “The CPSC report confirms that the industry’s commitment to rider education, parental supervision, and state legislation is working to bring down injury and fatality rates,” said Tim Buche, president of the Specialty Vehicle Institute of America (SVIA). “Millions of Americans operate ATVs safely and responsibly every day. It’s unfortunate that more than 92% of ATV-related fatalities involve one or more behaviors that the industry strongly and visibly warns against in its rider education programs, in all its literature, and on the vehicle itself. The industry’s top priority is to continue to work with the CPSC, user groups, retail dealerships, and all others interested in promoting ATV safety to further reduce the number of accidents resulting from misuse of the product.” Buche went on to say that, “We want to ensure that the injury trend continues in this direction – down, so it’s more important than ever to get the word out that kids don’t belong on adult-sized ATVs, and that all riders need to follow the industry’s recommended guidelines for safe and responsible riding. The bottom line is, even one crash or injury is one too many.” New public awareness campaign targets children/parents. The ATV industry continues to fund new education campaigns to promote ATV safety. Most recently, the industry provided funding to Weekly Reader for a nationwide education program, Protect Yourself, Protect the Planet, to promote ATV safety and environmental awareness. The program will include the distribution of 20,000 educational kits including a teacher’s guide, student activity booklet, parent take-home brochure, and classroom poster to middle schools and high schools in specific geographic areas with high ATV use across the country. The materials are designed to help educate families, students, teachers, and community leaders about ATV safety and how to be environmentally-responsible riders. Since 1986, the ATV industry has also promoted model state legislation that addresses vehicle misuse and restricts the operation of adult-sized ATVs to persons aged 16 and older. Following are the primary safety components of the industry’s Model ATV Safety Legislation: 1. Requires protective gear: All ATV riders are required to wear eye protection and an approved safety helmet. 2. Prohibits passengers: The carrying of passengers is not allowed in any circumstance. 3. Codifies operator age restrictions: No one under age 16 may operate an adult-sized ATV (engine capacity greater than 90cc) on public land. Youth-size ATVs (engine capacity 70cc up to and including 90cc) may be operated on public land only by those aged 12 and older. 4. Requires adult supervision: Persons under age 16 must be under continuous adult supervision while operating an ATV on public land. 5. Promotes education: States must implement a comprehensive ATV safety education and training program, which provides for the hands-on training of ATV operators. 6. Establishes safety certification: All persons operating an ATV on public land must have a safety certificate. 7. Prohibits ATV operation on public roads. There are approximately 20 states with comprehensive ATV legislation and approximately 20 with minimal ATV legislation. The industry will continue to focus on those states that have inadequate or no ATV safety legislation.
