The following text (attached also in Word document) outlines what policy and action points we expect the bill sponsors to include in any draft ATV Program bill. This will be the starting point from which to negotiate, it is not a Position Statement of the Association. It does, however, represent the most likely combination of details that can be expected to be in a final version of any bill that has the possibility of passage. We welcome your feedback on these points so that we may represent the interests of the diverse clubs from across the state during the upcoming process in Albany. The following does NOT constitute a Policy Position of the Association, it is a summary of points from draft Legislation as provided to us by Albany legislative staff. The following summarized the major points that we expect will be included in draft language of a standalone ATV Trail Program bill to be introduced in the Legislature, in lieu of the Program not being included in the final State Budget in April as had been worked for by your Albany lobbying staff. The expectation is that a bill will be first introduced in the Senate after the Legislature returns from Easter Break. I. ENFORCEMENT. State Aid available to every county and, if no county, any city, town or village within such county. (Not less than 30% of Fund). Includes planning and Program employee expenses. DEC Plan For The Development And Maintenance Of All Terrain Vehicle Trails And Facilities The DEC Commissioner shall establish a plan for the development and maintenance of all terrain vehicle trails and facilities and shall take whatever action he or she deems necessary to foster and promote the safe utilization of such trails and facilities. Two DEC Employees. For these purposes, he or she may draw upon the moneys deposited in the all terrain vehicle trail development and maintenance fund for expenses, including personal services, and is hereby authorized to assign two employees of his or her office to carry out such responsibilities and to pay their salaries, benefits and expenses out of such fund. II. SAFETY; EDUCATION AND TRAINING. State Aid available to every county, city, town, village, or a qualified not-for-profit organization shall be entitled to receive state aid. (Not less than 15% of Fund through Grants of up to 100% of the cost of such program). III. TRAIL DEVELOPMENT AND MAINTENANCE. All Terrain Vehicle Trail Development and Maintenance on Public Lands under jurisdiction of this state, including lands on which the state owns conservation or recreation easements must be made after a public hearing and subject to the following conditions: a) Terms of the Easement: b) Underlying Fee Title Interest: c) Natural Resource Protection. d) Compatibility with other public use. e) Public Safety. f) Maintenance. g) Illegal off-road ATV use. h) ATV access for Persons with Disabilities. Commissioner Determination Not in The Best Interests of The State. State Aid for All Terrain Vehicle Trail Development and Maintenance on public lands may be prohibited where the commissioner determines that the expenditure is not in the best interests of the state and issues a written determination thereto. In making such a determination the commissioner may consider: (a) threat to public lands due to the project's close proximity to such lands and (b) location adjacent to recognized nature areas or wildlife habitat areas. IV. AMAGE REMEDIATION. The state, its agencies, any county, city, town or village, and any private landowners suffering property damage of any kind directly attributable to the unauthorized use and trespass of all terrain vehicles on their property, shall be eligible to seek reparations from the All terrain vehicle trail development, enforcement and stewardship fund for damages suffered. V. ALL TERRAIN VEHICLE ROAD AND TRAIL MAP AND USER GUIDE. The commissioner shall, at the time of registration provide a copy of the all terrain vehicle road and trail map and user guide, developed by the department of environmental conservation to every person who registers an all terrain vehicle. VI. REGISTRATION NUMBER PLATES A set of permanent registration number plates shall be placed on an all terrain vehicle. One plate shall be placed on the front of the vehicle and one on the rear of the vehicle, as high as possible above the tires, each securely fastened so as to prevent the same from swinging. VII. FAILURE TO COMPLY; FINES AND PENALTIES. Failure to comply with a provision of law regarding the operation of an ATV shall constitute a violation and shall be punishable by a fine of not more than one hundred dollars. VIII. ATV ACCESS. Lands Dedicated To The Forest Preserve. No person shall operate an ATV on the real property of the lands dedicated to the forest preserve. Forest Preserve Lands. The Department may authorize the use of all terrain vehicles on forest preserve lands by the general public only on public highways. Conservation Easements The department may authorize the public use of all terrain vehicles on public highways, all terrain vehicle trails and private roads on conservation easements held by the department where such easements include the right to allow such use. Other State Lands. On state lands other than those described above, the department may authorize the public use of all terrain vehicles in compliance with the requirements of §2405 of V&T law. Criteria For Public Use Of All Terrain Vehicles On State Lands The department shall use the following criteria in determining whether to authorize the public use of all terrain vehicles on state lands under the department's jurisdiction: (1) The opening of each road or trail to public all terrain vehicle use must be authorized in an adopted unit management plan or recreation plan; (2) The natural resources of the area must be able to sustain continued use by all terrain vehicles; (3) Public all terrain vehicle access must be compatible with other public use of the area; (4) Except on conservation easements, public use of all terrain vehicles may be authorized solely to provide access to a traditional recreational program provided to the public by the department, (5) Each road or trail opened to public all terrain vehicle use must be safe for the operation of all terrain vehicles and the road or trail surface must be able to be maintained to prevent dangerous conditions; (6) Maintenance funds must exist to ensure that roads or trails that are opened to all terrain vehicles can be maintained to prevent the creation of muddy or eroded conditions; (7) It must be demonstrated that sufficient measures will be taken to prevent illegal all terrain vehicle use off of the surface of designated roads or trails; and (8) Authorization of public all terrain vehicle use must include provisions for monitoring, education and enforcement, including dissemination of information regarding where legal and safe public all terrain vehicle riding opportunities exist and increased enforcement patrols. Prohibited Areas. All you need are two days on your home trail or one day on an away trail to earn a free pass. The price of a TrailPass has increased to $60 for members. It is still $75 for non-members. • Many members attended the SNIRT Run on the Tug Hill. Good ride! Lots of snow, ice, dirt and mud!! About 100 miles long with lots of prizes. • Gary, Dave and Steve checked out Eight Bees Campground/ Riding area near Hazleton. Good Respectfully submitted, riding, beginner to intermediate. Jefferson County has hired an ATV Trail Coordinator. Scott Burto will be starting May 1st and we hope to have some good news to pass on as he begins his new tasks. We have several areas that we had planned on working on but were put on hold until he was hired. There is County property in the Winona Forest that has been un-usable for years and we hope to start the repairs to bring it up to a maintainable multi use trail system. As long as we don’t loose any more roads this will give the ATV’s a “Stepping Stone” to someday connect Oswego, Lewis & Jefferson Cnty’ s. The Washington Park area has deteriorated with lack of a trail maintenance plan and would like to see that area restored to a usable trail system. The roads connecting the Park and Lewis County is being enforced as non ATV trails so we defiantly need to work on opening a legal trail system there. NYTRO Central Chapter Meeting Minutes for March 5, 2006 NYTRO Central Chapter meeting called to order at 11:15AM at Gander Mountain with 18 members present. Old Business: The minutes were read by Paul Hansen from the last meeting and were approved by the members present. 3 new members were present, Doug Dose, Tom Diahogiannis and Phil Lippens Sponsors – Joanne will bring in the updated sponsor & newsletter advertising information the next meeting to have members distribute to dealers. Paul brought up the list of members and the dealers that had been contacted last year. Marty was given some posters and information for 5 new dealers she will contact. Marty will email Joanne the information on these 5 dealers. Members who are visiting dealers are encouraged to make copies of the ride schedule from the website leave with dealers they visit. There is a new format and sponsors’ area in the newsletter, and the membership renewal notice will be posted in the next issue. Members were also asked to check with the dealers near them to ensure they have NYTRO information in their stores. April 22 Ride Tri-County ATV Club ride – The time and place for this rain or shine ride will be announced in the next newsletter. The cost will be $10 or if a rider wishes to join the Tri-County Club, the membership fee is $30 and will cover the cost of this ride as well. Oswego County ATV Club ride – Dale and Marty will check on a ride and campout with this club for AUGUST. Brasher Falls ride -Joanne will try to get information on a ride for AUGUST as well for the next meeting. New Meeting and Ride Location - Newark ride and meeting place no action has been taken yet. No report from Jeremiah on Pine Hill as a meeting place yet. No report from Brian on Palmyra Riding Ask. for a meeting / ride location yet. Ride Schedule - Tony has published the ride schedule for APRIL – JULY and was approved by the membership. The AUG & SEP is being worked on. The ride schedule will be posted on the Central Chapter website. Website – The Central Chapter website now has a chat room where members can discuss rides and activities. Joanne said members may need to attempt to logon 3 times before they can get in depending on their computer. New business: Land use for riding - Joanne placed an ad in the 11 county Penney Savers but was not in the place where she had wanted it. One response was received from a land owner who only had 25 acres of land. Jeremiah sent a letter to a land owner in Victor who has 200 acres of land but the electronic letter could not be opened so Joanne will follow up with Jeremiah to see if the landowner can be contacted. Joanne requested to run another add in the Penny Saver for land at a cost of $60. This was approved by the membership unanimously. All of the above ride suggestions are to be presented at the next meeting for the membership to consider. Treasury - $26.00 was spent for the Central Chapter PO Box. Fund Raiser – Joanne asked for ideas on fund raisers and it was decided that the Central Chapter would have 50 / 50 raffles at rides. Joanne has the tickets and raffles will be conducted at future rides. The D.E.C. Avon show was discussed and Joanne will try to coordinate a tent, table and raffle for this event. NYTRO Inc. Meeting - Joanne said the NYTRO Inc. meeting is April 2nd and asked for member(s) to attend with her. Tony and Bob will contact Joanne about going to the meeting. TrailPass – Joanne mentioned that she has not heard from Trail Pass for a while and will contact them to see about member renewal and TrailPass activities. After everyone was done eating, they announced the winning highest and winning lowest By Gary Burns, STNY President On Saturday, April 23rd, I and six other NYTRO members went to a Poker Run in Lawton, PA. Registration was from 9:00 am ‘til 10:00 am. The parking registration was located at a farm. Pam and I actually arrived early. The reason for this was that she just got a new Arctic Cat 400 LE and was very eager to ride it. We had picked it up on Thursday. After meeting up with everyone from NYTRO Southern Tier, we headed down to the up into groups. About 10:00 am someone stepped up on a pickup and made announcements. They had to cut out some of the trails due to the rain. We would be riding more dirt roads then trails due to the rain. “Also, wear a helmet if you got one. The next ride will require helmets.” We also would be riding all together as one group. There were 150 riders registered for the ride. It was going to be a “long” ride. hands.
